Terms of Service

This page is the website-ready version of the current Runna terms draft. It is useful now for review and internal alignment, but should still be attorney-reviewed before you treat it as final public language.

Acceptance

By using Runna’s website, apps, restaurant tools, or driver tools, you agree to these Terms. If you do not agree, do not use the service.

Services

Runna provides software and logistics coordination for restaurant ordering, dispatch, delivery, and related support.

Availability is limited by geography, service hours, staffing, restaurant participation, weather, and operational constraints.

Customer orders

  • Customers must provide accurate order, contact, and delivery information
  • Customers should be available to receive deliveries when needed
  • Orders may be declined, delayed, cancelled, or refunded if payment is incomplete, the address is outside the service area, the restaurant cannot fulfill the order, delivery cannot be completed safely, or fraud or abuse is detected

Pricing and payments

Prices shown may include item subtotal, tax, delivery fee, automatic gratuity, and optional extra tip.

Payments are processed through Stripe. By completing checkout, the customer authorizes the charge shown at checkout.

Refunds and issues

Refund decisions may depend on the issue involved, including duplicate charge, non-delivery, materially incorrect order, restaurant rejection, or operational failure.

Runna may review each case individually.

Service area

Runna may limit delivery to defined service areas, including Aspen-only service at launch. Addresses outside the live service zone may be rejected.

Restaurant and driver accounts

Runna may suspend or remove accounts for misuse, fraud, unsafe conduct, or breach of terms.

  • Provide accurate information
  • Use the platform only for legitimate business operations
  • Keep credentials secure
  • Follow applicable law, safety rules, and platform procedures

Location and tracking

Driver tools may use location services to support dispatch, routing, delivery status, and customer tracking. Use of the driver app may require active location permissions.

Intellectual property

The Runna service, branding, software, workflows, and content are owned by Runna or its licensors unless otherwise stated. Users may not copy, reverse engineer, or exploit the service outside permitted use.

Disclaimers and liability

The service is provided on an “as is” and “as available” basis to the extent permitted by law. Runna does not guarantee uninterrupted availability, error-free service, or specific delivery times.

To the maximum extent permitted by law, Runna is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service. Aggregate liability should be limited to the amount paid in connection with the specific order giving rise to the claim, except where prohibited by law.

Indemnity, governing law, and updates

Users agree to indemnify and hold Runna harmless from claims arising from misuse of the service, fraud, unlawful conduct, or violation of these Terms.

These Terms should be reviewed by Colorado counsel, but the intended governing law is Colorado law, without regard to conflict-of-law rules.

We may update these Terms from time to time. Continued use after an update means the user accepts the revised Terms.
